In 2013, under a memorandum of understanding between the Canadian Environmental Assessment Agency (CEAA) and the British Columbia Environmental Assessment Office (BC EAO), the federal Minister of Environment approved the province's request for substitution for the environmental assessments for the Sukunka Project. This means the Sukunka Project is proceeding through the provincially led environmental review process.

Both the federal government and the provincial government will need to make their own separate decisions regarding environmental regulatory approvals before the Sukunka Project can proceed to become an operating mine. Under Canadian law, mining activity is a provincial authority. In British Columbia, mining activities are regulated by the Ministry of Energy, Mines and Petroleum Resources.
